N.Y. judge says he may allow Empire State Building REIT plan

(Reuters) - A New York judge said on Monday he was leaning toward allowing a group that wants to roll the Empire State Building into a real estate investment trust to force any holdouts to surrender their holdings for a fraction of their value.

New York Supreme Court Justice O. Peter Sherwood said he would issue his written decision regarding Malkin Holdings' plan for the landmark building by the end of Tuesday at the latest.

Under the plan, the Empire State Building - owned by Empire State Building Associates LLC, an entity controlled by Malkin - would join at least 18 other properties in the REIT called Empire State Realty Trust Inc and launch an initial public stock offering.

The plan requires support from 80 percent of each of the three groups of investors who as early as 1961 put money in the entity that became the limited liability company. For four decades after its completion in 1931, the building ranked as the world's tallest building.

Last month Malkin filed regulatory documents that said it had garnered about 95 percent of the investor votes it needs to cross the 80 percent threshold.

Once Malkin reaches that threshold, it claims the right to force any remaining investors to sell back their stakes for $100 each unless they drop their opposition. The units, now held by 2,824 investors, could be worth more than $320,000 apiece if the REIT becomes publicly traded.

The decision under consideration by Justice Sherwood involves that provision. Opponents of the REIT plan contend that Malkin lost the right to force holdouts to sell their holdings in 2001, when he converted Empire State Building Associates into a limited liability company from a partnership.

A REIT is a property or mortgage company that is exempt from corporate income taxes if it distributes at least 90 percent of its taxable income to shareholders in the form of dividends.

OLYMPIA, Wash. (AP) ? After struggling to sway both state and federal lawmakers, proponents of expanding background checks for gun sales are now exploring whether they will have more success by taking the issue directly to voters.

While advocates generally prefer that new gun laws be passed through the legislative process, especially at the national level, they are also concerned about how much sway the National Rifle Association has with lawmakers.

Washington Rep. Jamie Pedersen, a Democrat who had sponsored unsuccessful legislation on background checks at the state level, said a winning ballot initiative would make a statement with broad implications.

"It's more powerful if the voters do it ? as opposed to our doing it," Pedersen said. "And it would make it easier for the Legislature to do even more."

On Monday, proponents of universal background checks in Washington will announce their plan to launch a statewide initiative campaign that would require the collection of some 300,000 signatures, according to a person involved in the initiative planning who spoke on condition of anonymity so as not to pre-empt the official announcement.

The Washington Alliance for Gun Responsibility has scheduled a fundraiser in Seattle at the end of next month and hopes to have a campaign budget in the millions of dollars.

Ballot measures may be an option elsewhere, too. Hildy Saizow, president of Arizonans for Gun Safety, said an initiative is one of the things the group will be considering as it reconsiders strategies. An organizer in Oregon was focused on the Legislature for now but wouldn't rule out a ballot measure in the future if lawmakers fail to pass a proposed bill there.

While advocates have had recent success on background checks in places like Connecticut and Colorado, they've been thwarted in some other states and in Congress. The U.S. Senate rejected a plan to expand background checks earlier this month, although lawmakers in the chamber are still working to gather additional votes.

Brian Malte, director of mobilization at the national nonprofit lobbying group Brady Campaign to Prevent Gun Violence, said passage through Congress is the ideal in order to have a national solution and so that states with strong gun laws aren't undermined by nearby states with weaker standards. He noted that initiative campaigns are costly endeavors that can drain important, limited resources.

Still, Malte said, the ballot measures are an option to consider.

"At some point, certainly decisions need to be made about what the right time is to say we take it to the people," Malte said.

Brian Judy, a lobbyist who represents the NRA in Washington state, did not return calls seeking comment about the new initiative. He has previously said the NRA would likely oppose such an effort, arguing that the recently proposed laws on background checks would largely impact law-abiding citizens instead of the intended targets such as criminals and the mentally ill.

Gun measures have had mixed results at the ballot. More than 70 percent of Washington state voters rejected a 1997 initiative campaign that would have required handgun owners to pass a safety course. After the Columbine High School massacre in 1999, voters in Colorado and Oregon approved ballot measures the next year to require background checks for buying weapons at gun shows.

Following another massacre in Colorado earlier this year, state lawmakers approved a bill to expand background checks to private transactions and online purchases. A similar expansion plan in Oregon is stalled in the state Senate.

Some states don't see initiatives as a viable option right now. In Missouri, state Rep. Stacey Newman has been pushing for background checks with little success. While she spoke positively about the idea of a ballot initiative, she said there's no serious consideration of it because of the cost and coordination required just to get it on the ballot. Instead, the supporters of background checks in the state are simply working to prevent NRA-supported legislation from passing the state's General Assembly.

"We're continually on defense," she said.

Gun buyers currently must undergo a background check when they purchase a weapon from a federally licensed firearms dealer but can avoid checks in most states by using private purchases, such as at gun shows.

Washington state advocates believe polls show the public is sufficiently on the side of expanding background checks further. An independent Elway Poll conducted two months ago found that 79 percent of registered voters in Washington state supported background checks on all gun sales, including private transactions.

That wasn't enough to shepherd the bill through the Legislature. Even in the state House, which is controlled by Democrats, supporters fell short after an NRA campaign put pressure on some lawmakers. Pedersen had offered concessions through the process, including the option of sending the measure out for a public vote and exemptions for people who already have concealed pistol licenses or law enforcement credentials.

Pedersen said he was working with the initiative organizers on language for the proposal, and he said the Legislature would first have another chance to adopt the measure early next year. If it fails among lawmakers again, the proposal would then automatically go to the ballot, where Pedersen said he welcomed a campaign competing against groups like the NRA.

"I'm not afraid of it at all," Pedersen said. "The public is really with us. It's the right policy. I think it can be useful for further progress."

Nintendo has just offered us some better reasons to scrimp and save by quietly offering both the DSi XL and 3DS through its refurb shop. The used (and occasionally bruised) systems respectively start at $100 and $130, or $30 and $40 less than they'd normally cost -- enough to justify splurging on a game or two. While the selection is currently scarce, we'll set that qualm aside when everything gets the same year-long warranty as a new unit. About the only debate left is whether or not we're looking for a dedicated game machine in the first place.

DAMASCUS, Syria (AP) ? Syria's prime minister escaped an assassination attempt Monday when a bomb went off near his convoy in Damascus, state media reported, the latest attack targeting a top official in President Bashar Assad's regime.

Prime Minister Wael al-Halqi was unhurt in the bombing in the capital's western neighborhood of Mazzeh, state TV said. The TV showed footage of heavily damaged cars and debris in the area as firefighters fought to extinguish a large blaze set off by the explosion.

The state SANA news agency said one person was killed and several were wounded in the blast.

The daring attack in the upscale neighborhood, which is home to many embassies and government officials, was another blow to the regime, exposing its vulnerability in the very seat of Assad's powerbase.

Syria's conflict started with largely peaceful anti-government protests in March 2011 but eventually turned into a civil war that has so far killed more than 70,000 people, according to the United Nations.

A Syrian government official told The Associated Press that an improvised explosive device was placed under a car that was parked in the area and was detonated as al-Halqi's car drove by. The official spoke on condition of anonymity because he was not authorized to speak to the media.

The state-run Al-Ikhbariya station said al-Halqi went into a regular weekly meeting with an economic committee straight after the bombing and showed him sitting around a table in a room with several other officials.

The TV said it was showing the video as a proof that al-Halqi was not hurt. But the prime minister's comments after the meeting did not refer to Monday's blast and he was not asked about it by reporters, leaving doubts as to whether the footage was filmed before or after the bombing.

Al-Halqi condemned the blast, SANA said, adding that the attempt exposes how armed groups "are bankrupt" after the latest advances made by Syrian troops around the country.

The Britain-based Syrian Observatory for Human Rights said Monday's bombing killed al-Halqi's bodyguard and that one of his drivers was in critical condition. The group relies on a network of activist around the country.

The brazen attack in the highly secure Mazzeh neighborhood took place only about 100 meters (yards) from the residence of the Swiss ambassador. The posh area is also home to a major military air base, and security forces sealed it off shortly after the blast, allowing only pedestrians to come close.

At the scene of the bombing, damaged cars were surrounded by debris, their seats soaked with blood. A blackened shell of a school bus was left standing. A man told state TV that none of the students on board were hurt because the explosion went off shortly after they had left the bus and headed into the school.

The attack was not the first targeting a high official in the Syrian capital over the past year.

On July 18, a blast at the Syrian national security building in Damascus during a meeting of Cabinet ministers killed top four officials, including the defense minister and his deputy, who was Assad's brother-in-law. That attack also wounded the interior minister.

In December, a car bomb targeted the Interior Ministry in Damascus, killing several people and wounding more than 20, including Interior Minister Mohammed al-Shaar. Initially, Syrian state media said al-Shaar was not hurt in the Dec. 12 blast. News of his wounds emerged a week later, after he was brought to neighboring Lebanon for medical treatment for a serious back injury.

Earlier in April, Ali Ballan, head of public relations at the Ministry of Social Affairs and a member of Syria's relief agency, was shot dead while dinning in a restaurant in Mazzeh.

There was no immediate claim of responsibility for Monday's attack.

Massive bombings like the one that struck the prime minister's convoy have been a trademark of Islamic radicals fighting alongside the Syrian rebels, raising concerns about the extremists' role in Syria's civil war.

Al-Halqi, a senior member of Assad's ruling Baath party, took office last year after his predecessor, Riad Hijab, defected to Jordan. Al-Halqi was Syria's health minister before taking the post. He is a member of Assad's ruling Baath party and hails from the southern city of Daraa, the birthplace of the Syrian uprising.

Elsewhere in Syria, the Observatory reported fighting Monday near the Damascus International Airport to the south of the capital. The group said there were also clashes in the northern neighborhood of Barzeh and shelling of the Palestinian refugee camp of Yarmouk, south of Damacus.

The Observatory and another activist group, the Local Coordination Committees, reported clashes and air raids around the military helicopter base of Mannagh near the border with Turkey in the northern province of Aleppo. On Sunday, the Aleppo Media Center said that the rebels have seized 60 percent of the Mannagh air base.

Both groups also reported clashes and shelling Monday in the northwestern province of Idlib and the central region of Homs.

Apr. 25, 2013 ? Every year millions of birds make heroic journeys guided by Earth's magnetic field. How they detect magnetic fields has puzzled scientists for decades. Today, the Keays lab at the Research Institute of Molecular Pathology in Vienna has added some important pieces to this puzzle.

Their work, published in Current Biology, reports the discovery of iron balls in sensory neurons. These cells, called hair cells, are found in the ear and are responsible for detecting sound and gravity. Remarkably, each cell has just one iron ball, and it is in the same place in every cell. "It's very exciting. We find these iron balls in every bird, whether it's a pigeon or an ostrich" adds Mattias Lauwers who discovered them "but not in humans." It is an astonishing finding, despite decades of research these conspicuous balls of iron had not been discovered.

This finding builds on previous work by the lab of David Keays who last year showed that iron-rich cells in the beak of pigeons that were believed to be the magnetic sensors, were really just blood cells. "These cells are much better candidates, because they're definitely neurons. But we're a long way off to understanding how magnetic sensing works -- we still don't know what these mysterious iron balls are doing." said Dr Keays. "Who knows, perhaps they are the elusive magnetoreceptors" muses Dr Keays "only time will tell."

Novel approach to find RNAs involved in long-term memory storage

Apr. 25, 2013 ? Despite decades of research, relatively little is known about the identity of RNA molecules that are transported as part of the molecular process underpinning learning and memory.

Now, working together, scientists from the Florida campus of The Scripps Research Institute (TSRI), Columbia University and the University of Florida, Gainesville, have developed a novel strategy for isolating and characterizing a substantial number of RNAs transported from the cell-body of neuron (nerve cell) to the synapse, the small gap separating neurons that enables cell to cell communication.

Using this new method, the scientists were able to identify nearly 6,000 transcripts (RNA sequences) from the genome of Aplysia, a sea slug widely used in scientific investigation.

The scientists' target is known as the synaptic transcriptome -- roughly the complete set of RNA molecules transported from the neuronal cell body to the synapse.

In the study, published recently in the journal Proceedings of the National Academy of Sciences, the scientists focused on the RNA transport complexes that interact with the molecular motor kinesin; kinesin proteins move along filaments known as microtubules in the cell and carry various gene products during the early stage of memory storage.

While neurons use active transport mechanisms such as kinesin to deliver RNA cargos to synapses, once they arrive at their synaptic destination that service stops and is taken over by other, more localized mechanisms -- in much the same way that a traveler's bags gets handed off to the hotel doorman once the taxi has dropped them at the entrance.

The scientists identified thousands of these unique sequences of both coding and noncoding RNAs. As it turned out, several of these RNAs play key roles in the maintenance of synaptic function and growth.

The scientists also uncovered several antisense RNAs (paired duplicates that can inhibit gene expression), although what their function at the synapse might be remains unknown.

"Our analyses suggest that the transported RNAs are surprisingly diverse," said Sathya Puthanveettil, a TSRI assistant professor who designed the study. "It also brings up an important question of why so many different RNAs are transported to synapses. One reason may be that they are stored there to be used later to help maintain long-term memories."

The team's new approach offers the advantage of avoiding the dissection of neuronal processes to identify synaptically localized RNAs by focusing on transport complexes instead, Puthanveettil said. This new approach should help in better understanding changes in localized RNAs and their role in local translation as molecular substrates, not only in memory storage, but also in a variety of other physiological conditions, including development.

"New protein synthesis is a prerequisite for maintaining long term memory," he said, "but you don't need this kind of transport forever, so it raises many questions that we want to answer. Man named in ricin mailing case goes into hiding

SALTILLO, Miss. (AP) ? As investigators searched a Mississippi man's house earlier this week as part of their probe of poisoned letters sent to the president and others , Everett Dutschke answered reporters' questions but remarked, "I don't know how much more of this I can take."

The answer was apparently: Not much more.

On Thursday, Dutschke (pronounced DUHS'-kee), who has not been charged with a crime, had slipped from public view and stopped talking to the news media as investigators searched a home where he'd spent part of Wednesday. The home is about 20 miles away from his primary residence and former business in Tupelo, Miss., which had been searched earlier in connection with the letters that allegedly contained ricin.

Dutschke just needed to get away from all the media attention, a friend told The Associated Press on Thursday. Kirk Kitchens said he and Dutschke stayed at a home for a while Wednesday before slipping out through the woods to rendezvous with someone who drove Dutschke elsewhere.

"I just helped him get out of the spotlight," Kitchens said at his home in nearby Saltillo.

Although Dutschke has apparently gone into hiding, the man's attorney said he is cooperating and the FBI knows how to reach him.

As a plane circled overhead for much of the day, investigators on Thursday looked through the home where Dutschke spent time a day earlier.

Authorities are trying to determine who sent the letters last week to President Barack Obama, Sen. Roger Wicker of Mississippi and earlier to an 80-year-old Mississippi judge named Sadie Holland.

Charges were initially filed against an entertainer who is an Elvis impersonator, but then dropped. Attention then turned to Dutschke, who has ties to the former suspect and the judge and senator.

Dutschke has not been arrested or charged in the letters case. The FBI has said nothing about the building searches or Thursday's developments.

Dutschke's lawyer, Lori Nail Basham, said there is no arrest warrant for her client, who he said continues to cooperate with investigators.

Earlier Thursday, Itawamba County Sheriff Chris Dickinson said agents told him Dutschke had been under surveillance, but authorities weren't sure where he had gone. He said they were satisfied he was not at the Ozark property.

Dutschke did not answer a call to his cellphone Thursday from the AP. He had previously kept in touch with AP reporters.

It was yet another strange turn in the case that began when charges were filed against 45-year-old entertainer Paul Kevin Curtis, whose lawyers now say he was set up for the crime.

Charges against Curtis were dropped Tuesday after authorities said they developed new information. His attorney, Christi McCoy, has said she does not know what new information led the FBI to abandon the charges but that the agency acted in good faith and worked from the information it had at the time.

The focus then turned to Dutschke.

"I don't know how much more of this I can take," Dutschke said Tuesday as investigators combed through his house. His business was searched the next day.

Hal Neilson, another attorney for Curtis, said the defense gave authorities a list of people who may have had a reason to hurt Curtis, and Dutschke's name came up. He said prosecutors "took it and ran with it."

Dutschke and Curtis were acquainted. Curtis said they had talked about possibly publishing a book on an alleged conspiracy to sell body parts on a black market. But he claimed they later had a feud.

Judge Holland is a common link between two men who have been investigated and both know Wicker.

Holland was the presiding judge in a case in which Curtis was accused of assaulting a Tupelo attorney in 2004. Holland sentenced him to six months in the county jail. He served only part of the sentence, according to his brother.

Holland's family has had political skirmishes with Dutschke in the past.

Her son, Steve Holland, a state representative, said he believes his mother's only other encounter with Dutschke was at a rally in the town of Verona in 2007, when Dutschke ran as a Republican against Steve Holland.

Holland said his mother confronted Dutschke after he made a derogatory speech about the Holland family. She demanded that he apologize, which he did.

Steve Holland said he doesn't know if his mother remembers Curtis' assault case.

The software started life on Symbian and Series 40 devices before falling out of favor with Nokia, but this WP8 refresh enables cross-platform chatter between those older phones, the newer Lumia range and, as Yahoo Messenger contacts are supported, anything running that IM client, too. In addition to standard messaging, you can share your location with others, and send details about a specific place -- a restaurant, for example -- that'll link with Nokia Maps on Lumias for more info. (That sounds an awful lot like Nokia's other beta messaging app Pulse, doesn't it?) Other Lumia-only features in Nokia Chat include Live Tile and lock screen push notifications, Live Tile message previews, voice commands and text-to-speech composition.
